..."The property is managed on behalf of the United States by the Fish & Wildlife Service and is known as tract 562C. We have reviewed the Application for Conditional Use submitted by SSP Leasing... We have also reviewed the conservation easement... The Fish and Wildlife Service has determined mining activities are prohibited by the restrictions in the recorded conservation easement."

..."In the matter related to SSP Leasing for a Special Use Permit to mine and then develop the Brighton Farm site along with the adjacent Blake site, it would seem obvious the Township does not have standing to change the zoning as it simply does not have the right under law to stand in the shoes of the United States Fish and Wildlife services nor to stand in the shoes of  the United States."
